Adamawa Guber: Court dismisses Binani’s lawsuit against INEC

Justice Inyang Ekwo of the Federal High Court in Abuja has dismissed the lawsuit brought by the All Progressive Congress, APC Adamawa Governorship candidate, Senator Aisha Ahmed Binani, asking to be recognised as the election’s victor.
After the plaintiff filed a notice of discontinuance, Justice Ekwo dismissed the case.
Justice Ekwo rejected her request to dismiss the case, even though she had submitted a motion through her attorney Mr Mohammed Sheriff, stating that the court had already instructed the plaintiff to resolve the case’s jurisdictional issues.
To prevent the Independent National Electoral Commission, INEC, from declaring any other candidate the winner of the Adamawa State gubernatorial election, Senator Binani had filed an ex-parte suit with the court.
The APC candidate demanded in her lawsuit that after the collation process was completed, she be declared the winner of the governorship race.
She maintained that INEC lacked the authority to revoke or declare a declaration to be void.
