JUST IN: Court restraints VIO from inspecting, impounding vehicles

A Federal High Court in Abuja has made a groundbreaking ruling that restricts the Vehicle Inspection Office (VIO) from stopping vehicles, impounding or confiscating them, and imposing fines on motorists.

 

This judgment, delivered by Justice Evelyn Maha on October 2, 2024, is a significant victory for human rights activist Abubakar Marshal, who filed the fundamental rights enforcement suit.

 

The judge reads, “The VIO and its officials have no legal authority to stop, impound, confiscate vehicles, or impose fines on motorists.

 

“The court issued a restraining order against the VIO, Director of Road Transport, Area Commander in Jabi, Team Leader in Jabi, and the Minister of the Federal Capital Territory (FCT), preventing them from impounding or confiscating vehicles or imposing fines.

 

“Justice Maha granted a perpetual injunction to safeguard Nigerians’ rights, ensuring freedom of movement, presumption of innocence, and right to own property without lawful justification.

 

This landmark ruling is expected to have significant implications for traffic enforcement practices and motorists’ rights in Nigeria. It’s a major step forward in protecting citizens from unlawful actions by government agencies.
