NOW THAT WARRI BUSINESS MOGUL HAS LOST HIS CASE AGAINST MR PAUL TUSEMONE AT THE APPEAL COURT, ASABA, AND HIS CURRENT DRAMA OF AN ILLEGAL FENCE BEING ERECTED IN THE OLD NPA AREA AMOUNTS TO CONTEMPT OF COURT (1), BY MR PAUL TUSEMONE

1. Mr Paul Tusemone had been in a legal battle with Chief Tunde Smooth over Tunde’s claim of ownership of old NPA,Warri, having allegedly purchased nine warehouses from the government in suit number W/392/2010.This claim contained in suit number W/392/2010 was always contested by Mr Paul Tusemone who claimed it was an oppressive and intimidation device used by Tunde to intimidate poor people in NPA and that there was no evidence that he had bought NPA from the relevant authorities. In suit number W/392/2010 at the High Court, Warri, Tunde claims of ownership were dismissed and judgement given in favour of Mr Paul Tusemone because Chief Tunde Smooth could only show evidence of four CIS dilapidated warehouses bought rather than nine warehouses.

2. In another legal battle at the Appeal Court, Asaba,with suit number CA/AS/63/2020 in pursuit of the same matter, judgement was given in favour of Mr Paul Tusemone on 28th March, 2023 with N500,000 cost awarded in favour of Mr Paul Tusemone. By this judgement, it is clear that Tunde has legally lost his right to parade himself as the owner of old NPA,Warri.

3. I am hereby calling on all the Ijaws to jubilate and resist further intimidation and harassment by Tunde because all his ownership claims have been dismissed in the Appeal Court,Asaba.This calls for jubilation in NPA.

4. However, this judgement means that any further move by Chief Tunde Smooth to parade himself as the owner of old NPA,Warri, on the claims of having bought nine warehouses would be tantamount to contempt of court and the relevant sections of the law would be invoked against him in the relevant court.

5. It is saddening to note that Chief Tunde Smooth is currently constructing a fence in the NPA area with a vindictive mind and a show of power having recently lost his case in the Appeal Court, Asaba. Because he has lost his case in the Appeal Court, Asaba, with a bruised ego, he is currently playing to the gallery to bamboozle the ordinary people that he(Tunde) is still in charge of the old NPA area when he knows in actuality he has lost the legal battle.This is a dangerous phenomenon and Tunde must be ready to face a charge bordering on contempt of court.

6. Let the whole world, including the Ogbe-Ijoh Warri kingdom, know that Chief Tunde Smooth has lost his proprietary right over his hitherto claimed nine warehouses in the old NPA area,Warri, rather than four CIS dilapidated warehouses, through the judgement of the Appeal Court,Asaba, given on 28 March 2023.The era of Tunde’s intimidation is over.

7. Let Chief Tunde Smooth go to Supreme Court, Abuja, if he wishes to pursue his legal battle further rather than currently erecting an illegal fence in the old NPA area behind the Customs Police to further oppress the poor people which is a clear case of contempt of court as contained in the judgement of the Appeal Court, Asaba. I am waiting for Tunde at the Supreme Court if he feels he has a genuine case of proprietary right over old NPA,Warri.
