Justice M N Yunusa of the Federal High Court, Kano ruled that Abia State governor-elect, Alex Otti, all Labour Party candidates’ emergence was not in compliance with the provisions of the 2022 electoral act.

The court of law nullified the Abia state governor-elect, Alex Otti, asserting that he didn’t comply with the provisions of the 2022 electoral act

The court explained that the Labour Party failed to submit its membership register to the INEC within 30 days before their primaries rendering the process invalid.

According to a suit filed by Mr Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, the court ruled that the failure of the Labour Party to submit its membership register to the Independent National Electoral Commission within 30 days before their primaries renders the process invalid.

The judge ruled, “The party that has not complied with the provisions of the electoral act cannot be said to have a candidate in an election and can not be declared winner of an election, being so, the votes credited to the first defendant is a wasted vote as the decision of the supreme court.”
